Terms of Service

These Terms of Service (the “Terms”) govern your use of the website at california-motorsports.com (the “Site”) and the services offered by California Motorsports (“California Motorsports,” “we,” “us,” or “our”), located at 1150 N 2nd St, El Cajon, CA 92021. By accessing the Site, submitting an inquiry or quote request, placing an order, or using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.

01Who We Are

California Motorsports is an automotive customization, performance, and collision repair business serving San Diego County from El Cajon, California. Our services include color-change and commercial vehicle wraps, paint protection film, window tint, wheels and performance upgrades, tuning, collision repair and paint through our affiliated California Collision Center locations, and architectural surface wraps and signage for residential, commercial, and industrial clients.

02Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law;
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• Introduce viruses or malicious code, or use bots, scrapers, or other automated tools to access or copy Site content;
• Submit false, misleading, or fraudulent information through any form, order, or account; or
• Interfere with or disrupt the Site or other visitors’ use of it.

We may suspend or terminate your access to the Site at any time for conduct that we believe violates these Terms or is harmful to us or others.

03Quotes, Estimates, and Inquiries

Submitting a quote request, build inquiry, or collision estimate request through the Site does not create a contract or reserve a service date. Prices, timelines, and availability shown on the Site or provided in response to an online inquiry are preliminary and are based solely on the information you provide. A final estimate is prepared only after we have inspected your vehicle, surface, or project in person.

Please make sure the contact details, vehicle information, and photos you submit are accurate and complete. Inaccurate or incomplete information may change the scope, cost, or timing of the work.

04Vehicle and Project Services

Written authorization. All repair, customization, installation, and wrap work is performed under a written estimate and work authorization (a repair order or job agreement) that you approve before work begins, as required by California law. The signed estimate, work authorization, invoice, and any written warranty we provide at delivery govern that specific job. If those documents conflict with these Terms, the signed documents control for that job.

Changes and supplements. If additional parts, labor, or damage are discovered after disassembly or inspection, we will contact you for approval before performing additional work. We are not responsible for delays caused by parts availability, supplier backorders, insurance approvals, weather, or other circumstances beyond our reasonable control.

Pre-existing conditions. We note visible pre-existing damage at check-in. We are not responsible for pre-existing damage, wear, prior repairs, rust, corrosion, paint defects, or mechanical or electrical conditions that were not caused by our work, or for issues that arise from previously undiagnosed conditions.

Personal property. Please remove valuables and personal items from your vehicle before drop-off or pick-up. We are not responsible for personal property left in a vehicle.

Pick-up, delivery, and test drives. When you use our vehicle pick-up and drop-off service, or when our technicians drive your vehicle for diagnosis, alignment, or quality control, you authorize us to operate the vehicle for those purposes.

Completion and storage. We will notify you when your vehicle or project is ready. Vehicles not picked up within three (3) days after notification may be subject to daily storage fees at the rate posted at our shop or stated on your repair order. California law grants repair facilities a lien on vehicles for unpaid repair, parts, and storage charges, and we reserve all rights available under that law.

05Performance Parts, Tuning, and Modifications

Aftermarket parts, tuning, wraps, tint, lighting, exhaust, suspension, and other modifications may affect your vehicle’s manufacturer warranty, insurance coverage, emissions compliance, or legality for street use. Certain performance products are sold or installed for off-road or closed-course use only, and some modifications require a California Air Resources Board (CARB) exemption or must comply with California window tint, lighting, noise, and equipment laws.

You are responsible for confirming that any modification you request is legal for your intended use and for any effect on your warranty or insurance. By requesting a modification, you confirm that you understand and accept these risks. Performance and tuning results depend on vehicle condition, fuel quality, and driving conditions and are not guaranteed.

06Collision Repair and Insurance Claims

Online collision estimates are preliminary. Final repair costs are determined after teardown and inspection and may be supplemented as hidden damage is found. If you are paying through an insurance claim, you authorize us to communicate with your insurer and its adjusters, share photos, estimates, and vehicle information, and submit supplements on your behalf. You remain responsible for your deductible, any charges your insurer declines to pay, and any upgrades or additional services you request. Under California law, you have the right to choose the facility that repairs your vehicle.

07Payment

Payment is due in full upon completion of work unless other arrangements are agreed in writing. Deposits may be required for custom orders, special-order parts, materials such as wrap film and paint protection film, and reserved installation dates, and may be non-refundable once materials have been ordered or work has begun, except as otherwise required by law. We accept the payment methods listed on your estimate or invoice. Returned payments and past-due balances may be subject to fees and interest as permitted by law.

08Warranties

Workmanship warranties, if any, are provided in writing on your invoice or in a separate written warranty at delivery. Parts, film, tint, and other materials are covered by the manufacturer’s warranty, if any, and we will assist you with manufacturer claims where we can. Except as expressly stated in writing, and to the fullest extent permitted by law, our services and products are provided without any other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Warranties do not cover damage caused by accidents, misuse, improper care, racing or competition use, environmental conditions, or work performed by others.

09Online Store

Products offered through the Site’s shop are subject to availability. We try to display accurate pricing, descriptions, and images, but errors can occur. We reserve the right to correct errors, update information, and cancel orders placed at an incorrect price, in which case we will refund any amount you paid. Orders are accepted when we send a shipping or ready-for-pickup confirmation. Applicable sales tax and shipping charges are added at checkout. Risk of loss passes to you when the carrier accepts the shipment or when you pick up your order.

Unless otherwise stated at the time of purchase, unused products in their original packaging may be returned within thirty (30) days of delivery for a refund or store credit, less original shipping costs. Custom, special-order, installed, and electronic tuning products are final sale. Please contact us before returning any item. Products purchased for installation at our shop are covered by the service terms above.

10Photos, Reviews, and Submissions

Photos, descriptions, and other materials you submit through the Site remain yours. By submitting them, you grant us a non-exclusive, royalty-free license to use them to evaluate, quote, and perform the requested work. We may photograph and record video of vehicles and projects we work on and use those images in our portfolio, website, social media, and advertising. If you would prefer that your vehicle or project not be featured, tell us in writing before work begins and we will honor your request. Reviews and testimonials you provide may be published with your first name and last initial.

11Intellectual Property

The Site and its content, including text, photographs, videos, graphics, logos, build designs, and the California Motorsports name and marks, are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may view the Site and share links to it for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written permission. Vehicle manufacturer names, model names, and logos that appear on the Site belong to their respective owners and are used for identification only. We are not affiliated with or endorsed by any vehicle manufacturer unless expressly stated.

12Third-Party Services and Links

The Site includes content and links from third parties, such as embedded YouTube videos, our Instagram feed, Google Maps and reviews, WhatsApp chat, and payment processors. Those services are governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices.

13Disclaimer and Limitation of Liability

The Site is provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete or current.

To the fullest extent permitted by law, California Motorsports and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of profits, diminished vehicle value, rental or transportation costs, or loss of data, arising out of or related to the Site, our services, or these Terms. Our total liability for any claim arising from a specific job or order will not exceed the amount you paid us for that job or order. Nothing in these Terms limits liability that cannot be limited under California law, including liability for our own gross negligence or willful misconduct.

14Indemnification

You agree to defend, indemnify, and hold harmless California Motorsports and its owners, employees, and affiliates from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, inaccurate information you provide, or your use of a modified vehicle in violation of applicable law.

15Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If a dispute arises, please contact us first so we can try to resolve it informally. Any legal action relating to the Site or these Terms will be brought in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a qualifying claim in small claims court.

16General

These Terms, together with our Privacy Policy and any signed estimate, work authorization, invoice, or written warranty, make up the entire agreement between you and California Motorsports regarding the Site and our services. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these Terms without our written consent.

17Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date, and changes take effect when posted. Your continued use of the Site or our services after an update means you accept the revised Terms.
